1. Who these terms are between
These terms are between Aesoni (“we”, “us”) and the business that subscribes to AesoniONE FranchiseOS (“you”, “your”). By using the service you accept them.
2. The service
We provide AesoniONE FranchiseOS, a software service for managing multi-branch business operations, delivered over the internet and through desktop and mobile applications.
We may change, add or remove features. Where a change materially reduces functionality you rely on, we will give reasonable notice.
3. Your account
You are responsible for the accounts you create, the access you grant, and activity that occurs under them. Keep credentials secure and tell us promptly if you believe an account has been compromised.
4. Your data
Your business data remains yours. We process it to provide the service, as described in our Privacy Policy.
On cancellation you may export your data for 30 days, after which it is permanently deleted.
5. Fees
Subscription fees are as set out in your plan and are payable in advance. Prices exclude GST, which is charged at the applicable rate. Fees are non-refundable except as set out in our Refund Policy.
6. Acceptable use
You may not use the service to break the law, infringe others’ rights, attempt to gain unauthorised access to our systems or other customers’ data, or resell the service without a reseller agreement.
7. Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be notified where practical.
The product includes offline capability so a branch can keep operating during an internet outage. That is a product feature, not a warranty about your internet connection, your hardware, or your local network.
8. Liability
To the extent permitted by law, our total liability in connection with the service is limited to the fees you paid in the twelve months before the claim.
We are not liable for indirect or consequential loss, including lost profits or lost business.
Nothing here excludes liability that cannot be excluded under Indian law, including under the Consumer Protection Act 2019 where it applies.
9. Termination
You may cancel at any time; the subscription runs to the end of the paid period.
We may suspend or terminate for material breach, non-payment, or use that endangers the service or other customers, with notice where practical.
10. Governing law
These terms are governed by the laws of India, and the courts of Gujarat have exclusive jurisdiction.
